Giftme eGift Cards Terms of Service

These terms explain how you earn, use, and manage Cashback Points on Giftme. Please review carefully.

• Definitions:
  • Cashback Points – Promotional rewards earned through qualifying activities.
  • Giftme Card – Non-expiring credit applied toward purchases at participating merchants after redeeming Cashback Points.
• Earning Cashback:
  • Earn points from activities like purchases, referrals, birthdays, and promotions shown in the app.
  • Each activity has unique rules (e.g., rate, limits, timing) displayed in the app or campaign page.
  • Only eligible transactions/activities earn points. Eligibility is decided by Giftme or the merchant.
  • 1 Cashback Point = JMD $1.00 when redeemed.
  • Points are issued at the discretion of Giftme or the merchant.
  • Points may remain pending until the underlying transaction is verified, settled, and confirmed as eligible.
  • Giftme may modify, pause, or end any earning activity at any time.
• Merchant Criteria:

  Each participating merchant sets its own cashback terms, which may include:

  • Cashback rate (e.g., 5% or $100)
  • Minimum spend
  • Maximum cashback per transaction or period
  • Frequency limits (e.g., once per day/week)
  • Usage restrictions (e.g., in‑store only)
  • Validity period

  Merchant terms may change without notice. Changes apply only to new transactions and do not affect points already earned.

• Redemption:
  • Redeem points once you meet the threshold shown in the app.
  • Redemption permanently converts points to your Giftme Card (cannot be undone).
  • Giftme Card is used as a credit at checkout with any participating merchant.
  • Points and Giftme Card have no cash value and cannot be exchanged for cash.
• Expiration:
  • Cashback Points expire annually on the anniversary of your Giftme account creation date (e.g., account created June 6, 2023 → points expire June 6, 2024).
  • Your expiration date is shown in your account.
  • Expired points are removed automatically and cannot be restored.
  • Giftme Card from redeemed points does not expire unless otherwise stated.
• Merchant Suspension or Removal:
  • If a merchant suspends or ends its cashback program, it will no longer appear in the cashback list.
  • Cashback Points you already earned from that merchant remain valid until they expire or are redeemed.
• Fraud, Abuse & Account Integrity:
  • We may cancel points or suspend accounts for fraud, abuse, or violations of these terms.
  • Examples include using multiple accounts to bypass limits, providing false or misleading information, or returns or chargebacks on qualifying purchases .
  • You can contact support to dispute any such action.
• Reversals and Clawbacks:

  If a qualifying transaction is refunded, cancelled, reversed, disputed, charged back, voided, or found to be ineligible, any associated Cashback Points, credits, or promotional benefits may be reversed, cancelled, or clawed back.

• Non-Transferability:
  • Cashback Points and Giftme Card are personal to you. They are not property, and may not be sold, assigned, pledged, or transferred to another person or account.
• Disclaimer & Limitation of Liability:
  • We do not guarantee the availability, accuracy, or continued participation of any merchant or offer. To the fullest extent permitted by law, we are not liable for any losses or missed earnings resulting from changes, suspensions, merchant withdrawal, technical issues, or errors.

The Giftme Card is a reloadable gift card within the Giftme app, designed for use exclusively in the Giftme ecosystem. This convenient feature allows users to store funds securely and use them for various transactions within the app. Please note that the Giftme Card is not transferable and is intended for use only within the Giftme platform and partner merchants.

1. Reload Methods: Add funds to your Giftme Card through the Giftme Smart Card.
2. Non-Refundability: All reload methods are non-refundable, except as required by law.
3. Forfeiture of Funds: Funds in accounts that are inactive for 5 years will be forfeited. We will attempt to notify you before forfeiture, but it's your responsibility to keep the account active.
4. Spending Limit: The monthly spending limit for the Giftme Card is $250,000 JMD.
5. Liability: Giftme is not liable for losses resulting from unauthorized access caused by your failure to maintain the security of your account, device, or login credentials. Report any unauthorized access or fraudulent activity immediately.
6. Termination of Service:
   • Giftme reserves the right to terminate your use of the Giftme Card for reasons including, but not limited to, breach of these terms, illegal or fraudulent activity, or actions that are in violation of financial regulations.
   • In the event of termination due to illegal or fraudulent activity, we will cooperate with law enforcement as required by law, in accordance with the requirements for compliance with financial regulations.
   • We will provide notice of termination where feasible. In cases where immediate termination is necessary to protect the security and integrity of the service, notice may be provided as soon as practically possible.
   • Upon termination, you must cease all use of the Giftme Card and any outstanding funds may be subject to forfeiture or returned as per applicable laws and regulations.

The following terms apply when you use Giftme to pay in-store, including payments made through a linked debit or credit card. By using this feature, you agree to these terms in addition to Giftme's Terms of Service, Terms of Sale, and Privacy Policy.

• About This Feature:

  Giftme lets eligible users pay at participating stores using a debit or credit card linked to their Giftme account.

• Who Can Use It:
  • Access depends on your account status, linked payment method, device compatibility, merchant participation, location, verification level, and subscription tier.
  • The merchants and payment methods available to you may change at any time without prior notice.
• How Payments Are Processed:
  • You may need to complete one or more steps to authorize a payment, such as app confirmation, QR scan, card authentication, or identity verification.
  • Giftme reserves the right to decline, delay, hold, or request additional verification for any transaction at its sole discretion.
• Your Responsibility:
  • Always review your transaction details carefully before confirming. You are responsible for ensuring accuracy.
  • Keep your device, login credentials, and in-app security settings secure. Giftme accepts no liability for losses resulting from unauthorized access caused by your failure to protect your account.
• Payments Are Final:

  Once you confirm a payment, it may be processed immediately. Confirmed payments cannot be cancelled, reversed, exchanged, or refunded, except where these terms expressly allow it or where required by applicable law.

• Fees:

  All card processing fees are passed on to you. Applicable fees are disclosed when you first link your card. No additional hidden fees will be applied beyond what was disclosed, except charges imposed by a third party or by operation of law.

• Merchant Participation:
  • Participating merchants, available offers, rates, and eligibility rules may be added, changed, paused, or removed at any time without prior notice.
  • Giftme does not guarantee the continued availability of any specific merchant, offer, or promotion.
• Availability:

  In-store payment availability may be affected by outages, maintenance, third-party provider issues, merchant restrictions, compliance requirements, or fraud review. Giftme does not guarantee uninterrupted access to this feature.

• Fraud and Security:

  Giftme may review, delay, reject, cancel, reverse, suspend, or restrict any payment, benefit, or account activity where fraud, abuse, unauthorized use, suspicious conduct, policy violations, or legal or regulatory risk is suspected. Giftme may also withhold value, freeze access, or require additional verification while a review is pending.

The following terms apply when you subscribe to Giftme Premium. By subscribing, you agree to these terms in addition to Giftme's Terms of Service, Terms of Sale, and Privacy Policy.

• About Giftme Premium:

  Giftme Premium is a recurring subscription that provides eligible users with access to certain benefits while the subscription remains active.

• Billing and Renewal:
  • Subscriptions renew automatically for the selected billing period unless cancelled before the renewal date.
  • You authorize Giftme to charge your selected payment method for the applicable subscription fee, taxes, and any other disclosed charges on each renewal date.
  • Cancellation must be completed before the renewal date to avoid charges for the next billing period.
• Benefits:
  • Premium benefits apply immediately upon successful subscription.
  • Benefits may vary by plan, merchant participation, geography, account eligibility, and feature availability, and may change from time to time.
• Cancellation:

  You may cancel at any time. Cancellation stops future renewals but does not reverse charges for the current billing period. Unless otherwise stated, you retain access to benefits until the end of your current paid period.

• Refunds:

  Subscription fees are generally non-refundable, except where required by applicable law or where Giftme expressly states otherwise. Prorated refunds may be available in limited circumstances at Giftme's discretion.

• Tier Changes:
  • Tier upgrades take effect immediately.
  • Downgrades take effect at the next billing cycle.
  • Giftme reserves the right to modify tier benefits with notice.
• Free Trials and Promotions:
  • Free trial or promotional periods may be offered to new subscribers.
  • A payment method is required to start a trial. Billing begins automatically after the trial ends unless you cancel before the trial period expires.
  • Trial terms are specified at sign-up.
• Price Changes:

  Giftme may change subscription pricing with notice. Price changes take effect at the start of your next billing cycle after the notice period.

• Fraud and Misuse:

  Giftme may limit, revoke, or suspend subscription benefits where fraud, abuse, resale, manipulation, or violation of program rules is suspected.

The following terms apply when you shop through MiniStore — Giftme's in-app shopping experience that connects you with third-party merchants and stores. By using MiniStore, you agree to these terms in addition to Giftme's Terms of Service, Terms of Sale, Privacy Policy, and any applicable merchant terms.

• About MiniStore:

  MiniStore lets you browse, shop, and complete purchases with third-party merchants ("Partner Stores") directly within the Giftme app. You can pay using your Giftme Card, linked cards, or other supported payment methods.

• You're Buying from the Merchant, Not Giftme:
  • When you place an order through MiniStore, your purchase is with the Partner Store — not with Giftme — unless Giftme is clearly identified as the seller for that specific transaction.
  • Partner Stores are independent businesses. They are not owned, operated, or controlled by Giftme.
• What the Merchant Is Responsible For:

  Each Partner Store is solely responsible for its products, descriptions, pricing, stock, fulfillment, delivery, returns, refunds, cancellations, warranties, customer support, and compliance with all applicable laws. Listing a Partner Store on MiniStore does not constitute an endorsement or guarantee by Giftme.

• What Giftme Provides:

  Giftme provides the storefront interface, payment processing, order relay, and account access for MiniStore transactions. Giftme does not control the Partner Store's inventory, delivery operations, fulfillment quality, or merchant-side policies unless expressly stated otherwise.

• Orders, Pricing, and Availability:
  • Products, prices, merchants, delivery windows, and availability shown in MiniStore may change at any time without notice.
  • A Partner Store may reject, cancel, or be unable to fulfill an order due to stock limits, service-area restrictions, technical issues, or other operational reasons.
• Payments and Fees:

  All charges — including product prices, service fees, delivery charges, taxes, and surcharges — will be shown at checkout before you confirm. Once confirmed, your payment may be processed immediately and cannot be reversed except as permitted by the Partner Store's own policies, these terms, or applicable law.

• Delivery Issues and Disputes:
  • For questions about delivery, order accuracy, missing items, product quality, or merchant policies, contact the Partner Store directly.
  • Giftme may help facilitate communication but is not obligated to resolve disputes between you and a Partner Store.
• Refunds and Returns:
  • Refund and return policies are set entirely by each Partner Store. Giftme does not process refunds for Partner Store products.
  • If a Partner Store approves a refund, Giftme may assist with processing the refund to your original payment method.
• Your Data:

  To process your orders, Giftme may share necessary information (such as your name, contact details, and order details) with the Partner Store for fulfillment, payment processing, fraud prevention, and support, in accordance with Giftme's Privacy Policy. Partner Stores may have their own privacy policies.

• Store Availability:

  Partner Stores may be added, removed, or temporarily unavailable at any time. Giftme may discontinue any Partner Store relationship at its sole discretion without prior notice.

• Promotions and Eligibility:

  Promotions, discounts, cashback, or incentives available through MiniStore may be subject to additional eligibility rules, merchant conditions, budget limits, geographic restrictions, time windows, or usage limits. Giftme or the relevant merchant may change or end promotions at any time for future transactions.

• Fraud and Misuse:

  Giftme may delay, restrict, suspend, cancel, refuse, or reverse any MiniStore transaction or related account activity where fraud, abuse, policy violations, suspicious conduct, or legal or regulatory risk is suspected. This includes the right to withhold value and freeze access while a review is pending.

The following terms apply when you use Giftme to pay bills. By using Bill Pay, you agree to these terms in addition to Giftme's Terms of Service, Terms of Sale, and Privacy Policy.

• About This Feature:

  Bill Pay lets you make payments to supported utility providers, service companies, and other billers directly from the Giftme app.

• Supported Billers:

  The billers available through Giftme may change at any time without notice. The list shown in the app at the time you make your payment is what applies to your transaction.

• Double-Check Your Details:
  • You are responsible for entering the correct account number, reference number, biller selection, and payment amount. Always verify your details with your biller before paying.
  • Giftme is not liable for payments that fail, post late, or go to the wrong account because of incorrect information you provided.
• Processing and Posting:

  Giftme processes your payment promptly, but it may take 1–3 business days for the payment to appear on your biller's account. Posting times depend on the biller's own systems and processing cycles.

• Fees and No Refunds:

  All applicable fees and charges will be shown before you confirm. Once a bill payment is confirmed and processed, it is final and non-refundable, except where required by applicable law.

• Issues with Your Biller:

  Questions about your bill balance, whether a payment has posted, late fees, service reconnection, overpayments, or any biller account issues must be directed to the biller. Giftme cannot resolve biller-side matters on your behalf.

• Failed Payments:

  If a bill payment fails before it is completed, Giftme may reverse the charge or work with you to resolve the issue through our internal review process.

• Availability:

  Bill Pay availability may be affected by outages, maintenance, third-party provider issues, biller restrictions, compliance requirements, or fraud review. Giftme does not guarantee uninterrupted access to Bill Pay.

• Fraud and Security:

  Giftme may delay, reject, cancel, or place conditions on any bill payment where fraud, unauthorized use, suspicious activity, or compliance concerns are suspected. Giftme may also freeze access or withhold funds while a review is pending.

The following terms apply when you use Giftme to buy mobile credit, airtime, or data bundles. By using Mobile Topup, you agree to these terms in addition to Giftme's Terms of Service, Terms of Sale, and Privacy Policy.

• About This Feature:

  Mobile Topup lets you purchase prepaid mobile credit, airtime, data bundles, and similar telecom products for supported networks directly from the Giftme app.

• Supported Networks:

  Available networks, products, denominations, and bundle options may change at any time. What you see in the app at the time of purchase is what applies.

• Double-Check Your Number:
  • You are responsible for entering the correct mobile number, selecting the right network, choosing the right amount, and picking the correct bundle type.
  • Giftme is not liable for topups sent to a wrong number, wrong network, or unsupported product because of information you entered incorrectly.
• Processing Speed:

  Topups are usually processed within seconds, but timing may vary depending on the telecom provider's systems, network conditions, service outages, or fraud review.

• Fees and No Refunds:
  • All fees and charges will be displayed before you confirm your purchase.
  • Once a topup is successfully processed, it is final and non-refundable, except where required by applicable law.
  • Fees may vary based on topup amount and payment method.
• Failed Topups:

  If a topup fails before completion or does not reach the recipient's phone, Giftme may reverse the charge or work with you to resolve the issue.

• Telecom Provider Rules:

  Your topup is also subject to the telecom provider's own rules, including product restrictions, activation conditions, usage limits, expiry periods, and service terms. Giftme has no control over how the telecom provider applies your credit.

• Fraud and Security:

  Giftme may delay, restrict, cancel, refuse, or review any topup where fraud, abuse, suspicious activity, unauthorized use, or legal or regulatory risk is suspected. Giftme may withhold funds or freeze access while a review is pending.

The following terms apply when you purchase international or third-party digital gift cards, vouchers, or codes through Giftme. By making a purchase, you agree to these terms in addition to Giftme's Terms of Service, Terms of Sale, and Privacy Policy.

• About This Feature:

  Giftme lets you purchase digital gift cards, vouchers, and codes from international brands and providers. These products are sourced from third-party suppliers and made available for purchase within the Giftme app.

• Pricing and Availability:
  • Available brands, denominations, exchange rates, and pricing may change at any time without notice. What you see at checkout is what applies to your purchase.
  • Prices are displayed in JMD and may include the card's face value, foreign exchange markup, and service fees.
  • Exchange rates are set at the time of purchase and cannot be adjusted after the fact.
• Giftme Is Not the Card Issuer:

  Giftme acts as a reseller or distributor. We do not issue international gift cards and do not operate the brand's redemption systems. Giftme is not affiliated with or endorsed by the gift card brands unless expressly stated otherwise.

• Digital Delivery:
  • Gift cards are delivered digitally — in-app, by email, or through another method shown at the time of purchase.
  • Delivery is usually instant but may take up to 24 hours in some cases.
  • You are responsible for entering the correct recipient email or delivery details. Giftme is not liable for undelivered cards due to incorrect information you provided.
  • Treat your gift card codes like cash. Never share them with anyone you do not intend to receive them.
• Brand Terms and Regional Restrictions:
  • Each gift card is governed by the issuing brand's own terms, including territory restrictions, account requirements, expiry dates, redemption conditions, and acceptance policies.
  • Some cards may only work in specific regions (for example, an Amazon US card can only be redeemed on Amazon.com).
  • It is your responsibility to check any brand-specific restrictions before you purchase.
• All Sales Are Final:

  Once a gift card code has been generated, delivered, or made available to you, the sale is final. No refunds, returns, or exchanges are permitted, except where required by applicable law.

• Redemption Issues:

  If you have trouble redeeming a card — including issues with brand account restrictions, regional acceptance, partial use, or expiration — you must contact the brand or provider directly. Giftme cannot resolve issuer-side issues unless we expressly agree to do so.

• Brand Responsibility:
  • International gift cards are issued and honored solely by their respective brands.
  • Giftme bears no liability for any brand's actions, including changes to redemption policies or discontinuation of their gift card program.
• Suspicious or Bulk Purchases:

  Giftme may review, delay, limit, reject, or cancel unusual, high-volume, or suspicious purchases. Bulk orders may require additional identity verification. Giftme may withhold value or freeze access while a review is in progress.

The following terms apply when you participate in Giftme's referral program. By using this feature, you agree to these terms in addition to Giftme's Terms of Service, Terms of Sale, and Privacy Policy.

• About This Feature:

  Giftme allows eligible users to invite others, share referral links, or receive referral-related rewards subject to the program rules shown in the app.

• Eligibility:
  • Both referrer and referred user must have valid Giftme accounts and meet the eligibility criteria stated in the app or campaign details.
  • Eligibility includes completion of qualifying actions and compliance with program rules.
• No Self-Referrals or Abuse:

  Self-referrals, duplicate accounts, misleading promotion, automated traffic, fake signups, or any attempt to manipulate attribution or reward logic are prohibited and may result in forfeiture of rewards and account suspension.

• Reward Timing:

  Referral rewards are not earned until the qualifying conditions are completed and verified. Reward amounts and types may vary by promotion.

• Expiration:

  Referral links, campaign codes, and referral opportunities may expire, stop working, or become ineligible at any time.

• Program Changes:

  Giftme may change or end the referral program, including qualification rules and reward amounts, at any time for future activity.

• Fraud and Misuse:

  Giftme may review, delay, restrict, suspend, cancel, reverse, or refuse any referral reward or related account activity where fraud, abuse, manipulation, or policy violations are suspected.
